सर्वोच्चको न्यायाधीश बन्न सुवेदीको योग्यता पुगेको छैन : सर्वोच्च बार

काठमांडू। सुप्रीम कोर्ट बार एसोसिएशन ने कहा है कि नाहकुल सुलेदी ने सुप्रीम कोर्ट के न्यायाधीश के पद के लिए अर्हता प्राप्त नहीं की है। इस मुद्दे पर गंभीर होने का आग्रह करते हुए संसदीय सुनवाई समिति को एक ज्ञापन सौंपा गया है।

समिति में आरोप लगाया गया कि सूबेदार योग्य नहीं था। न्यायिक परिषद ने 11 फरवरी को सर्वोच्च न्यायालय के न्यायाधीश के पद के लिए मुख्य न्यायाधीश कुमार चुडाल और नाहकुल सुलेदी के नामों की सिफारिश की थी। अब वे संसदीय सुनवाई की तैयारी कर रहे हैं। बुधवार को आयोजित सुप्रीम कोर्ट की सलाहकार समिति की एक बैठक ने भी सुनवाई समिति का ध्यान आकर्षित करने की आवश्यकता पर जोर देते हुए कहा कि सूबेदार सुप्रीम कोर्ट के न्यायाधीश बनने के लिए योग्य नहीं थे। तदनुसार, सुप्रीम कोर्ट ने शुक्रवार को समिति के अध्यक्ष लक्ष्मण लाल कर्ण को एक ज्ञापन सौंपा। सुप्रीम कोर्ट ने सुबेदी से आग्रह किया है कि वे संविधान के अनुच्छेद 129, धारा 5 के अनुसार योग्य नहीं हैं और संविधान की भावना और पत्र के खिलाफ उनके नाम की सिफारिश की गई है। सुप्रीम कोर्ट ने सूबेदार की नियुक्ति सिफारिश के खिलाफ भी मामला दायर किया है। इस संबंध में एक निर्णय 12 अप्रैल को आ रहा है। Kathmandu. The Judicial Council had on February 11 recommended the names of Chief Justices Kumar Chudal and Nahakul Subedi for the post of Supreme Court judge. Now they are preparing for a parliamentary hearing. A meeting of the advisory committee of the Supreme Court held on Wednesday also stressed on the need to draw the attention of the hearing committee saying that Subedi was not qualified to be a judge of the Supreme Court. Accordingly, the Supreme Court on Friday handed over a memorandum to committee chairman Laxman Lal Karna. The Supreme Court has urged Subedi to be serious as he has not qualified as per Article 129, Clause 5 of the Constitution and his name has been recommended against the spirit and letter of the Constitution. The Supreme Court has also filed a case against Subedi's appointment recommendation. A decision in this regard is coming on April 12.
