 बामदेव पर अदालत के फैसले से पहले मंत्रिमंडल में फेरबदल की संभावना नहीं है

यह देखा जाता है कि पार्टी उपाध्यक्ष और नेशनल असेंबली सदस्य बामदेव गौतम के खिलाफ अदालत में दायर अंतिम रिट याचिका को अंतिम रूप देने तक कैबिनेट का पुनर्गठन नहीं किया जाएगा।

एक सूत्र के मुताबिक, पार्टी के अध्यक्ष नारायण काजी श्रेष्ठ को मंत्रिमंडल में फेरबदल के लिए कुछ दिनों का इंतजार करना होगा क्योंकि यह मुद्दे पर अदालत के फैसले के आधार पर तय किया जाएगा।

सूत्र ने कहा, "वामदेव के फैसले के बिना कुछ नहीं होता है," उन्होंने कहा कि "उन्हें अदालत द्वारा पूरी तरह से रोकना होगा, अन्यथा उन्हें कुछ समय तक इंतजार करना होगा।"

प्रतिनिधि सभा में पराजित हुए गौतम ने 19 सितंबर को सुप्रीम कोर्ट में रिट याचिका दायर कर मांग की थी कि सरकार उन्हें नेशनल असेंबली का सदस्य बनाए और मंत्री भी बनाए। अदालत, जिसने 22 सितंबर को प्रारंभिक सुनवाई की, बुधवार को आगे की सुनवाई कर रही है।

सुनवाई के दौरान, शीर्ष अदालत ने गौतम के पद को नेशनल असेंबली के सदस्य के रूप में बनाए रखने और अगले आदेशों तक उसे संवैधानिक अधिकारों को नहीं देने का आदेश दिया था।

प्रधानमंत्री और पार्टी अध्यक्ष केपी शर्मा ओली, जिन्होंने तत्काल कैबिनेट फेरबदल के होमवर्क को तेज कर दिया है, नए मंत्रियों के नाम तय करने के लिए एक सप्ताह के लिए कार्यकारी अध्यक्ष प्रचंड के साथ दैनिक चर्चा कर रहे हैं।

सूत्रों ने कहा कि जब तक गौतम का मामला नहीं सुलझता, तब तक प्रचंड खुद कैबिनेट में फेरबदल नहीं करने के पक्ष में हैं।

सूत्र ने प्रचंड के हवाले से कहा, "मैंने इस बात पर जोर दिया है कि कैबिनेट को तब तक पुनर्गठित नहीं किया जाना चाहिए जब तक कि बमदेवजी के खिलाफ मामला सुलझा नहीं लिया जाता।"

प्रधानमंत्री ओली को भी रविवार को अपने मंत्रिमंडल में फेरबदल की अफवाह थी। यह जानकारी प्राप्त करने के बाद कि उन्होंने उन्हें तत्परता की स्थिति में रहने का निर्देश दिया था, कार्यकारी अध्यक्ष प्रचंड ने प्रधानमंत्री ओली को ऐसा नहीं करने का सुझाव दिया था।

प्रचंड ओली के साथ अपनी लगातार बैठकों में एक ही बयान दोहरा रहे हैं।

नेपल्लभर ने कहा, "प्रधानमंत्री ने बलदेवजी पर फैसले से पहले पार्टी को पुनर्गठित करने पर जोर दिया।" प्रचंड जोर दे रहे हैं कि पार्टी के फैसले के खिलाफ मामला अदालत में नहीं सुलझना चाहिए।

प्रचंड ने पैकेज में संवैधानिक आयोग में पार्टी की एकता और अधिकारियों की नियुक्ति के बाकी काम पर सहमत होने का प्रस्ताव दिया है।

सचिवालय ने दो चेयरपर्सन और महासचिव बिष्णु पौडेल को निर्देश दिया था कि वे 10 दिनों में पार्टी एकता के बचे हुए काम को पूरा करने के लिए एक कार्ययोजना के साथ आएं।

दूसरी ओर प्रचंड चाहते हैं कि कैबिनेट के फेरबदल से पहले बाकी एकता का काम पूरा हो जाए।

प्रचंड ने मंगलवार को ओली के साथ बैठक में कहा, "पार्टी की एकता को समाप्त करने के लिए एक विस्तृत कार्ययोजना तैयार करने की समय सीमा से पहले केवल तीन दिन बचे हैं।"

दूसरी ओर, प्रधान मंत्री ओली ने कहा कि सरकार का काम कैबिनेट फेरबदल के बिना गति नहीं ले सकता।

बुधवार को अदालत में समान रिट पर बहस की जाएगी, प्रचंड ने कहा कि बिना धैर्य के कैबिनेट का पुनर्गठन करना उचित नहीं होगा और इससे अच्छा संदेश नहीं जाएगा।

सूत्रों का दावा है कि प्रचंड ने अपने मंत्रिमंडल में फेरबदल करने के प्रधानमंत्री के प्रस्ताव को खारिज कर दिया।

प्रचंड के हवाले से सूत्र ने कहा, "लगता है कि उनके पास केवल कुछ मंत्रियों का ही प्रयास है। मैं इससे सहमत नहीं हूं। अगर पार्टी को सरकार चलाना है, तो पार्टी को एक मंत्री भी भेजना चाहिए।"

इसी कारण से, प्रचंड प्रधानमंत्री के साथ अपनी हालिया चर्चा में सभी मंत्रियों को हटाने और नए लोगों को लाने के प्रस्ताव को दोहरा रहे हैं।

बालुवाटार के एक सूत्र के अनुसार, मंगलवार को हुई बैठक में सभी मौजूदा मंत्रियों को हटाने और एक नया 'सेट' लाने के प्रस्ताव के बाद इस मुद्दे को हल नहीं किया गया था।

बलुवतार के एक सूत्र ने बताया, "चेयरमैन प्रचंड ने प्रधानमंत्री को सुझाव दिया कि आप सभी को हटा दें और नया ले आएं। प्रधानमंत्री इस बात से सहमत नहीं थे।"

प्रचंड ने तर्क दिया है कि सभी को हटाया जा सकता है और जिन्हें इसकी आवश्यकता है उन्हें एक निश्चित मानक के आधार पर वापस लाया जा सकता है।

एडवोकेट दिनेश त्रिपाठी ने 2074 में बीएसपी के बर्दिया से प्रतिनिधि सभा का चुनाव हारने वाले गौतम की नियुक्ति के खिलाफ 19 अक्टूबर को सुप्रीम कोर्ट में नेशनल असेंबली में रिट याचिका दायर की थी।

रिट याचिका पर, सुप्रीम कोर्ट के न्यायाधीश आनंद मोहन भट्टाराई की पीठ ने 22 सितंबर को एक अंतरिम आदेश जारी किया था, जिसमें कहा गया था कि गौतम के संसदीय सीट को बनाए रखने के लिए आदेश दिया जाएगा और जब तक कि समस्या का समाधान नहीं हो जाता, तब तक उसे अधिक अधिकार नहीं दिए जाएंगे। बुधवार को दोनों पक्षों के वकील इस मामले पर चर्चा करेंगे।

अन्य दलों ने प्रधान मंत्री ओली पर आरोप लगाया है, जो केवल एक दशक के बाद कैबिनेट फेरबदल की तैयारी कर रहे हैं, एक अदालत द्वारा थोड़ी देर के लिए उनकी नियुक्ति को निलंबित करने का आदेश देने के बाद उनके मंत्रिमंडल में फेरबदल के लिए उन पर जुर्माना लगाया गया

Cabinet not likely to be reshuffled before court ruling on Bamdev

It is seen that the cabinet will not be reshuffled until the writ petition filed against the party vice-chairman and National Assembly member Bamdev Gautam is finalized.

According to a source, party chairman Narayan Kaji Shrestha will have to wait a few days for the cabinet reshuffle as it will be decided on the basis of the court's decision on the issue.

"Nothing happens without Vamdev's verdict," the source said, adding that "he has to be stopped completely by the court, otherwise he will have to wait for some time."

Gautam, who was defeated in the House of Representatives, had filed a writ petition in the Supreme Court on September 19 demanding that the government make him a member of the National Assembly and also a minister. The court, which held a preliminary hearing on September 22, is holding further hearing on Wednesday.

At the hearing, the apex court had ordered to keep Gautam's post as a member of the National Assembly and not to give him any more constitutional rights until further orders.

The Prime Minister and party president KP Sharma Oli, who has intensified the homework of immediate cabinet reshuffle, has been holding daily discussions with executive chairman Prachanda for a week to decide the names of the new ministers.

However, Prachanda himself is in favor of not reshuffling the cabinet until Gautam's case is resolved, sources said.

"I have emphasized that the cabinet should not be reconstituted until the case against Vamdevji has been settled by the court," the source said, quoting Prachanda.

Prime Minister Oli was also rumored to be reshuffling his cabinet on Sunday. After receiving information that he had instructed them to be in a state of readiness, Executive Chairman Prachanda had suggested to Prime Minister Oli not to do so.

Prachanda has been repeating the same statement in his continuous meetings with Oli.

"The prime minister's emphasis seems to be on reorganizing the party before the verdict on Bamdevji," the source told Nepalkhabar. "Prachanda is emphasizing that the case against the party's decision should not be settled in court."

Prachanda has proposed to agree on the rest of the work of party unity and appointment of officials in the Constitutional Commission in the package.

The secretariat had instructed the two chairpersons and general secretary Bishnu Poudel to come up with an action plan to complete the remaining work of party unity in 10 days.

Prachanda, on the other hand, wants the rest of the unity work to be completed before the cabinet reshuffle.

"There are only three days left before the deadline to formulate a detailed action plan to end party unity," Prachanda said in a meeting with Oli on Tuesday.

Prime Minister Oli, on the other hand, said the government's work could not pick up speed without a cabinet reshuffle.

As the same writ will be debated in the court on Wednesday, Prachanda said that it would not be appropriate to reconstitute the cabinet without patience and that would not send a good message.

Sources claim that Prachanda rejected the Prime Minister's proposal to reshuffle his cabinet.

"He seems to be trying to have only a few ministers to suit himself. I do not agree with that. If the party is to run the government, the party should also send a minister," the source said, quoting Prachanda.

For the same reason, Prachanda has been repeating the proposal to remove all the ministers and bring in new ones in his recent discussions with the Prime Minister.

According to a Baluwatar source, the issue was not resolved after he proposed to remove all the existing ministers and bring a new 'set' in the meeting held on Tuesday.

"Chairman Prachanda suggested to the Prime Minister to remove all but you and bring a new one. The Prime Minister did not agree to that," a Baluwatar source told Nepalkhabar.

Prachanda has argued that all can be removed and those who need it can be brought back on the basis of a certain standard.

Advocate Dinesh Tripathi had filed a writ petition in the Supreme Court on October 19 against the appointment of Gautam, who lost the House of Representatives election from Bardiya in 2074 BS, to the National Assembly.

On the writ petition, a bench of Supreme Court Judge Ananda Mohan Bhattarai had issued an interim order on September 22 ordering to keep Gautam's parliamentary seat as it is and not to give him more powers until the issue is resolved. Lawyers on both sides will discuss the matter on Wednesday.

Oli, who is preparing to reshuffle his cabinet only a decade later, has been accused by other parties of imposing fines for reshuffling his cabinet after a court ruled that Gautam's appointment should be suspended for a while.
